Is there a Risk?
I'm working in Company 'A'. My company is filing for H1 extension for me along with my wife's H4 Extension in the month of April (before that it is not possible it seems - according to lawyer or Imm. dept of company 'A')
Company 'B' is filing H1 visa for my wife on April 1st.
So my question is: Is there a RISK to file 2 separate petitions (H4 Extension and H1) in the same time frame?
If yes, what's the option?
If no, should I say to my employer or lawyer (Company 'A') to not to file H4 extension for my wife because of the overlap of time frames?

Instead of thinking of filing a lawsuit immediately, which could be expensive in my opinion, you should think about filing an MTR - Motion To Reconsider.

I wish that the closest strawberries, which happen to be the brightest ones that draw attention, could be in better focus. Using a smaller aperture would bring more of the berries into focus. Otherwise, I really like the photo. Good job! :cool:

Taxes are paid on earned money only. Not loans.
If your spouse takes a student loan in USA, there are other advantages though. He/she can claim student loan deduction on the taxes !! Not sure your Indian bank would provide the necessary forms to you or if they have a legal obligation to submit anything to IRS here.

Hi,
I got 2 year EAD from NSC in August 2008.
Wanted to apply for Advance Parole (second time).
Is NSC issuing 2 year AP's ?
Wondering if any body got Advance Parole for 2 years from NSC.
Also, I appreciate if any one can share their experince about INFOPASS to get Advance Parole in case of emergency
(if one did not apply for AP & need to travel urgently).

Hi,
Would some one post info on how to get directly to level 2 or 3 USCIS customer service rather than level 1. I Called USCIS couple of times, the customer said I need to wait 90 days to check the status with them. I filed in July and have no receipt. I would like to know whether my case is entered in USCIS database. Please guide!

I have i485 pending and working on EAD. H1b expired. I am on Eb3.
I have a opportunity to become a Manager in the same company....The job duties would ofcourse be different from Programmer/analyst position...
So can I take the promotion and use the EAD...Will I be using AC21
I would suggest you to check with a good lawyer, as both Job duties and Job title both are changing for you, this might be iffy for AC21.
By the way, if you have not done, whenever you get a chance please mail letter against AC21 cases getting wrongful denials(IV action item).

After a long journey on several non immigrant visa's my GC finally got approved. The questions that I would like to throw out for the group to think on is regarding the period for which one has to keep all the H1/H4 approval notices and supporting documents?
In my case, I have been here for 10 years and have a 15 pound folder that has all the approval notices (I-797) and supporting documents (copies of I-129, transcripts, everything under the sun)
I would hate to have to carry this for the rest of my life.
Lawyers - Your legal opinion would provide relief to my aching shoulders :)
